1. Services Scope & Geographic Limits
KolphaRx is an online portal that facilitates order placement and home delivery of pharmaceutical and medical items. Currently, our operations are localized, serving Ernakulam district and nearby operational sectors in Kerala, India. Orders requested from outside our serviceable areas will not be processed.
2. Prescription-Only (Rx) Medicines
In compliance with Indian healthcare regulations, we enforce strict guidelines for purchasing prescription-only medicines:
- Users must upload a valid, clear, and unexpired doctor's prescription issued by a registered medical practitioner.
- All prescription orders are reviewed and approved by a licensed pharmacist prior to packing and delivery.
- KolphaRx reserves the absolute right to reject or cancel any order if the uploaded prescription image is illegible, expired, fake, mismatching, or deemed invalid by the verifying pharmacist.
Verification Notice: Delivery personnel will check and match the original physical prescription at the time of delivery if required by the pharmacist.
3. Pricing, Billing, & Cancellation
- Prices displayed on the platform are estimates based on standard MRP. The final bill amounts are generated based on actual pack quantities and batch prices at the pharmacy shelf.
- We reserve the right to cancel orders due to stock unavailability, pricing errors, or verification failures.
- Users can cancel an order within 10 minutes of placement, or until the prescription has been verified and processed by the pharmacist.
4. User Responsibilities & Conduct
- You agree to provide true, accurate, and complete information when registering your account (name, phone number, and delivery coordinates).
- You are responsible for keeping your OTP codes private and secure. Any actions taken through your mobile account will be considered authorized by you.
- You agree not to upload false medical records, forged prescriptions, or engage in any fraudulent activity on the platform.
5. Disclaimers & Limitation of Liability
- Medical Disclaimer: KolphaRx is a platform facilitating delivery and pharmacy connections. We do not provide medical advice, diagnosis, or treatment. Always consult with a qualified doctor.
- Product Liability: All medicines are manufactured by third-party pharmaceutical entities. We are not liable for any adverse reactions, allergies, or efficacy issues of the medicines delivered.
- Availability: We aim for uninterrupted service but do not guarantee that the application will operate error-free or without temporary downtimes.
6. Regulatory Compliance
These terms and all operations of KolphaRx are governed by and comply with Indian legislation, including but not limited to:
- The Drugs and Cosmetics Act, 1940
- The Pharmacy Act, 1948
- The Information Technology Act, 2000
Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ernakulam, Kerala, India.
